Welcome to Maker Exchange. These Terms and Conditions (“Terms”) govern your access to and use of the Maker Exchange website, platform, and services (collectively, the “Platform”). By accessing or using Maker Exchange, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not use the Platform.
1. About Maker Exchange
Maker Exchange is an online marketplace that connects individuals and businesses seeking fabrication services (including but not limited to 3D printing, CNC machining, and laser cutting or engraving) with independent local makers who offer those services. Maker Exchange does not perform fabrication services itself and is not a party to transactions between users.
2. Eligibility
To use Maker Exchange, you must:
- Be at least 18 years old
- Have the legal capacity to enter into a binding agreement
- Provide accurate and complete account information
Maker Exchange reserves the right to suspend or terminate accounts that provide false information or violate these Terms.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify Maker Exchange immediately of any unauthorized use of your account.
Maker Exchange is not liable for losses resulting from unauthorized account access.
4. Listings and Services
4.1 Maker Listings
Makers may create listings describing their fabrication services, equipment, materials, pricing, and availability. Makers are solely responsible for the accuracy of their listings.
4.2 Service Requests
Customers may contact makers through the Platform to request services. All terms of a job — including price, timeline, materials, delivery, and revisions — are agreed upon directly between the customer and the maker.
Maker Exchange does not guarantee pricing, turnaround times, or service quality.
5. Payments
Maker Exchange may facilitate payments now or in the future. Unless explicitly stated otherwise:
- Payments are made directly between users
- Maker Exchange is not responsible for payment disputes
- Fees, taxes, and refunds are the responsibility of the parties involved
Maker Exchange reserves the right to introduce service fees or commissions with prior notice.
6. Intellectual Property
6.1 User Content
Users retain ownership of their designs, files, and other content uploaded to the Platform. By uploading content, you grant Maker Exchange a limited, non-exclusive license to use that content solely to operate and promote the Platform.
6.2 Responsibility for Designs
Customers represent that they own or have the right to use any files or designs submitted for fabrication. Makers are not responsible for verifying ownership or intellectual property rights.
Maker Exchange is not liable for intellectual property disputes between users.
7. Prohibited Uses
You agree not to:
- Upload unlawful, infringing, or harmful content
- Request or provide services for illegal or regulated items
- Misrepresent capabilities, materials, or qualifications
- Circumvent the Platform to avoid fees (if applicable)
- Harass, threaten, or abuse other users
Maker Exchange may remove content or suspend accounts at its sole discretion.
8. Quality, Safety, and Compliance
Makers are independent providers and are solely responsible for:
- The safety and quality of their work
- Compliance with local laws, regulations, and safety standards
- Proper handling of materials and equipment
Maker Exchange makes no warranties regarding fabricated items and is not responsible for defects, failures, or damages.
9. Disputes Between Users
Disputes regarding services, payments, quality, or delivery must be resolved directly between the customer and the maker. Maker Exchange may, but is not obligated to, assist in dispute resolution.
10. Limitation of Liability
To the maximum extent permitted by law, Maker Exchange shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
- Acts or omissions of users
- Defective or unsafe fabricated items
Your use of the Platform is at your own risk.
11. Indemnification
You agree to indemnify and hold harmless Maker Exchange, its owners, operators, and affiliates from any claims, damages, losses, or expenses arising from:
- Your use of the Platform
- Your violation of these Terms
- Your services, listings, or designs
12. Termination
Maker Exchange may suspend or terminate your access to the Platform at any time, with or without notice, for any violation of these Terms or for any reason deemed necessary to protect the Platform or its users.
13. Modifications to Terms
Maker Exchange may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the state in which Maker Exchange operates, without regard to conflict of law principles.
